FIDIC Contract

FIDIC (the Red Book, Yellow Book and Silver Book) is the international standard for major civil engineering and infrastructure contracts. FIDIC's programme obligations under Sub-Clause 8.3 are explicit and demanding — requiring a clear understanding of how claims, EOT and the engineer's role interact.

Sub-Clause 8.3 — Required Content

The programme must show the order in which the Works are to be executed, the anticipated timing of each stage, the sequence and timing of inspections and tests, a general description of the Contractor's methods, and supporting documents including resource and cash flow forecasts.

Time for Completion

The Time for Completion runs from the Commencement Date (defined in Sub-Clause 8.1) to the date of the Taking-Over Certificate. Milestones (Sections) may have separate Times for Completion, each with its own Delay Damages rate.

Extension of Time (Sub-Cl. 8.5)

EOT entitlement arises from listed causes including Variation instructions, Unforeseeable physical conditions (Sub-Cl. 4.12), Employer's delays and Exceptional Events. The Contractor must notify within 28 days of becoming aware — failure to notify forfeits entitlement.

28-Day Notice Requirement

One of FIDIC's most critical obligations — all claims for EOT or additional cost require a notice within 28 days of the event. Deltime tracks all potential claim events against the programme and raises notices on time, every time.

The Engineer

Under FIDIC, the Engineer acts as contract administrator with authority to approve, reject or vary the programme. Deltime prepares programmes in a format the Engineer can review, mark up and accept — with a clear audit trail for all revisions.

Delay Damages

Where the Contractor fails to complete by the Time for Completion, Delay Damages (liquidated damages) apply at the rate stated in the Contract Data — typically per day. Deltime's programme management is structured to provide contemporaneous evidence if this is disputed.
