Early Warnings & EOT

Protecting programme entitlement requires action at the right time — not after the event. Deltime manages the early warning and compensation event regime on live NEC projects, and prepares Extension of Time applications under JCT and FIDIC that are grounded in the programme and supported by contemporaneous evidence.

NEC Early Warning Notices

Under NEC, an early warning notice must be raised as soon as a party becomes aware of anything that could increase total cost, delay completion, or impair performance. Deltime tracks the programme closely to identify potential delay events before they crystallise and raises early warnings on the correct timescale — preserving the Contractor's entitlement and meeting the contractual obligation.

Risk Reduction Meetings

Once an early warning is raised, NEC requires a risk reduction meeting to be held. Deltime supports the Contractor in preparing for and attending these meetings — bringing the programme data, impact assessment, and proposed mitigation measures needed to make the discussion productive and the outcome well-documented.

NEC Compensation Event Quotations

A compensation event quotation under NEC must show the effect on both the Prices and the Completion Date. Deltime prepares CE quotations using the Accepted Programme as the baseline — demonstrating the critical path impact clearly, quantifying the delay with supporting programme analysis, and presenting a figure that can withstand the PM's scrutiny.

JCT Extension of Time (cl.2.28)

Under JCT, an EOT application must identify the Relevant Event, the activities affected, the critical path at the time, and the net time impact. Deltime prepares JCT EOT applications using impacted as-planned or time impact analysis as appropriate, with a clear programme extract and a narrative that links the event to the delay.

FIDIC EOT (Sub-Cl. 8.5 & 20.2)

FIDIC's EOT and claims regime requires notices within 28 days of the triggering event — failure to notify can forfeit entitlement entirely. Deltime tracks all potential FIDIC claim events against the programme and raises notices on time, preparing fully substantiated EOT submissions aligned to the Engineer's assessment process.

Notice Strategy & Entitlement Protection

Notices are only effective if they are raised at the right time, in the right format, and with the right content. Deltime advises contractors on notice strategy from the outset — identifying the notice obligations under the specific contract and building a contemporaneous record that supports entitlement if a claim arises later.
